Confidence Guarantee Terms
Scott Surplice Photography
These terms apply to the Scott Surplice Photography Confidence Guarantee.
The Confidence Guarantee is designed to give eligible couples the opportunity to experience what it is like to be photographed by Scott before their wedding and, if they decide Scott is not the right photographer for them, to end their booking and receive a refund of their Booking Fee.
1. Eligibility
The Confidence Guarantee is available to couples who:
book Scott Surplice Photography's 9-Hour Collection;
choose to opt into the Confidence Guarantee at the time of booking; and
have a wedding date that allows sufficient time for a Confidence Session to take place at least 90 days before the wedding.
The Confidence Guarantee is optional and must be selected when booking. It cannot be added to an existing booking at a later date unless agreed to by Scott Surplice Photography in writing.
The Confidence Guarantee applies only to the original wedding date and couple named in the Photography Agreement and is not transferable.
2. Booking Your Wedding
The normal booking process applies.
Your wedding date is secured once the Photography Agreement has been completed and the $1,000 Booking Fee has been paid.
Opting into the Confidence Guarantee does not change the normal booking requirements or payment schedule unless the Guarantee is subsequently exercised in accordance with these terms.
3. The Confidence Session
Couples who opt into the Confidence Guarantee are entitled to one complimentary 30-minute Confidence Session with Scott before their wedding.
Confidence Sessions are held on selected dates and at selected locations determined by Scott Surplice Photography. Couples will be offered available session options and can select from those available.
The Confidence Session is designed to allow you to experience Scott's normal approach to photographing couples before your wedding. It is not a bespoke engagement or portrait session and does not include your choice of date, location or extended photography coverage.
The Confidence Session must take place at least 90 days before the wedding, unless otherwise agreed by Scott Surplice Photography.
4. Rescheduling and Weather
If you need to reschedule your Confidence Session, one reschedule may be permitted provided reasonable notice is given and another suitable Confidence Session is available.
Scott Surplice Photography may postpone or reschedule a Confidence Session due to unsuitable weather or other circumstances that reasonably prevent the session from proceeding.
A weather postponement initiated by Scott Surplice Photography will not cause you to lose your Confidence Guarantee.
Failure to attend a scheduled Confidence Session without reasonable notice, or repeated failure to attend an agreed session, may result in the Confidence Guarantee expiring.
5. Your Photographs
Following the Confidence Session, Scott Surplice Photography will provide a small edited selection of photographs from the session.
The intention is to provide approximately 10–15 edited photographs within 3–5 days of the Confidence Session, although these numbers and timeframes are indicative rather than guaranteed.
The purpose of these photographs is to allow you to see the results of the session and consider both the experience of being photographed by Scott and the photographs created together.
6. Your 48-Hour Decision Period
Your Confidence Guarantee decision period begins when Scott Surplice Photography delivers the edited Confidence Session photographs to you.
You then have 48 hours from delivery of those photographs to decide whether you wish to continue with your wedding photography booking.
If you decide Scott is not the right photographer for you, you must notify Scott Surplice Photography in writing within that 48-hour period that you wish to exercise the Confidence Guarantee.
You do not need to provide a reason.
7. If You Exercise the Confidence Guarantee
If you validly exercise the Confidence Guarantee within the 48-hour decision period:
your $1,000 Booking Fee will be refunded in full;
your Photography Agreement with Scott Surplice Photography will end;
Scott Surplice Photography will have no obligation to photograph your wedding; and
your wedding date will immediately be released and may be made available to another couple.
Once the Confidence Guarantee has been exercised and the booking terminated, reinstatement of the original booking is not guaranteed and would be subject to Scott Surplice Photography's availability and agreement.
8. If You Do Not Exercise the Guarantee
If Scott Surplice Photography does not receive written notice from you within the 48-hour decision period, the Confidence Guarantee expires.
Your wedding photography booking will then continue under the normal terms of your Photography Agreement, including its standard payment, postponement and cancellation provisions.
9. What the Confidence Guarantee Does Not Cover
The Confidence Guarantee is intended to help you determine whether Scott Surplice is the right photographer for you.
It is not intended to provide a refundable booking because:
you decide to cancel your wedding;
your wedding plans change;
you change your wedding date or venue;
you no longer require wedding photography;
you fail to attend your Confidence Session; or
circumstances unrelated to your experience with Scott as your photographer cause you to reconsider your wedding photography booking.
These circumstances remain subject to the applicable terms of your Photography Agreement.
10. Relationship With Your Photography Agreement
The Confidence Guarantee operates alongside your Photography Agreement with Scott Surplice Photography.
If you opt into the Confidence Guarantee, the Confidence Guarantee provisions contained in your Photography Agreement form part of the contractual terms governing your booking.
Where there is any inconsistency between these website terms and your signed Photography Agreement, the terms of the signed Photography Agreement will apply to your booking.
11. Australian Consumer Law
The Confidence Guarantee is an additional promise offered by Scott Surplice Photography. It does not exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
